ACCOUNT AGREEMENT

This Agreement is your contract. It also contains disclosures required by the Federal Truth in Lending Act. Please read all of it and keep it for your records. You do not have to sign the Agreement, but once you have accepted, signed or used your card, you have agreed to the terms of the Agreement.
In this Agreement the words “you” and “your” means any individual who applies for, signs, accepts, uses, retains or authorizes the use of the Card. “Card” means the VISA® Card and any duplicates and renewals we issue. The words “we,” “us” and “our” means Excel Federal Credit Union. (EXCEL FCU)
1. EFFECTIVE DATE–This Agreement will become fully effective when we notify you of our approval of your Application and of the beginning Maximum Credit Limit which we have approved for you.
2. GENERAL–You may use your Account to buy or lease goods or services any place it is honored. You may also use your Account to get a cash advance. You agree to follow all procedures required by us or any merchant which honors your Account. You promise not to use the card or permit use of related cards to obtain purchases or loans which will exceed your credit limit. All credit purchases and loans are affected at the option of the seller and cash advancing institution and we are not responsible for refusal of any seller or cash advancing institution to honor the card or any related card. Any refund, adjustment or credit allowed by seller shall not be cash but rather by a credit advance to issuer which shall be shown as a credit on your account statement.
3. CREDIT INVESTIGATION–Since we have the sole right and discretion to approve your Application and allow you to take part in this Plan now and in the future, you authorize us at any time to make or have made whatever credit investigation we feel is proper to evaluate your credit, personal or financial standing and/or employment and you authorize us to disclose information regarding your account with credit bureaus, creditors and any others. You also agree to furnish us any financial statements we may request at any time and in such details as we may require.
4. MAXIMUM CREDIT LIMIT–If we approve your Application, we will notify you of the amount we have established as your Maximum Credit Limit and will issue you the Card. You agree never to allow your Outstanding Balance to exceed your Maximum Credit Limit. You agree that we may change the Maximum Credit Limit at any time upon written notice to you. You may request an increase in your Maximum Credit Limit by written or telephone application at any time. If you obtain any Advance by use of the Card in excess of your Available Credit, we may (but are not required to) honor the transaction and extend the credit to you even though this will cause your Outstanding Balance to be in excess of your Maximum Credit Limit; and you agree immediately, upon our demand, to repay us all amounts we have advanced in excess of your Available Credit. Should you exceed your approved Maximum Credit Limit on more than three occasions, we may terminate usage of the card and will not reissue the Card.
5. RESPONSIBILITY–If we issue you a Card, you agree to repay directly to the Credit Union all debts and Finance Charges arising from the use of the Card and the Card Account. If more than one person completed and signed the Application, each of you is both jointly and severally obligated for all payments due under this Agreement and Plan. You and all account signers are responsible for charges made by yourself, your spouse and minor children. You are also responsible for charges made by anyone else to whom you give the Card, and this responsibility continues until the account is closed and the balance is paid in full. You cannot disclaim responsibility by notifying us, but we will close the account for new transactions, if you so request and return all Cards. Your obligation to pay the Outstanding Balance on the Card Account continues even though an agreement, divorce decree or other court judgment of which we are not a party may direct you or one of the other persons responsible to pay the account.
6. MONTHLY PAYMENT–We will mail you a statement every month (the “Periodic Statement”) showing your Previous Balance of Purchases and Cash Advances, the current transactions on your account, the Available Credit under your Maximum Credit Limit, the New Balances of Purchases and Cash Advances, the Total New Balance, the Finance Charge due to date, other billed fees, and the Minimum Payment required. Each month, you may pay either the entire Outstanding Balance, which will reduce the Finance Charge or you may pay less than the Total New Balance shown as being due on the Periodic Statement, unless the entire Balance has become due under paragraph 16 of this Agreement. In any event, you agree every month to pay at least the Minimum Payment, at the place we designate, no later than the due date shown on each Periodic Statement.
Platinum VISA® : The Minimum Payment will be an amount equal to 3.00% of the Total New Balance plus any portion of the Minimum Payment(s) shown on prior statements which remain unpaid, or $20.00, whichever is greater, unless: (a) your Total New Balance is $20.00 or less, in which event the entire amount shall be due, or (b) your Outstanding Balance exceeds your Maximum Credit Limit, in which event the Minimum Payment will be the amount of the excess plus 3.00% of the Total New Balance plus the unpaid portion of any Minimum Payment shown on prior statements. If we allow you to skip a monthly payment, finance charges will continue to be applied to your outstanding balance. Also, this will not extend the time within which you must pay your Total New Balance in order to avoid a finance charge on purchases. The Minimum Payment will be due in the month following the month you skip.
Gold VISA® : The Minimum Payment will be an amount equal to 3.00% of the Total New Balance plus any portion of the Minimum Payment(s) shown on prior statements which remain unpaid, or $25.00, whichever is greater, unless: (a) your Total New Balance is $25.00 or less, in which event the entire amount shall be due, or (b) your Outstanding Balance exceeds your Maximum Credit Limit, in which event the Minimum Payment will be the amount of the excess plus 3.00% of the Total New Balance plus the unpaid portion of any Minimum Payment shown on prior statements. If we allow you to skip a monthly payment, finance charges will continue to be applied to your outstanding balance. Also, this will not extend the time within which you must pay your Total New Balance in order to avoid a finance charge on purchases. The Minimum Payment will be due in the month following the month you skip.
Classic VISA® : The Minimum Payment will be an amount equal to 2.50% of the Total New Balance plus any portion of the Minimum Payment(s) shown on prior statements which remain unpaid, or $10.00, whichever is greater, unless: (a) your Total New Balance is $10.00 or less, in which event the entire amount shall be due, or (b) your Outstanding Balance exceeds your Maximum Credit Limit, in which event the Minimum Payment will be the amount of the excess plus 2.50% of the Total New Balance plus the unpaid portion of any Minimum Payment shown on prior statements. If we allow you to skip a monthly payment, finance charges will continue to be applied to your outstanding balance. Also, this will not extend the time within which you must pay your Total New Balance in order to avoid a finance charge on purchases. The Minimum Payment will be due in the month following the month you skip.
New Start VISA® : The Minimum Payment will be an amount equal to 3.00% of the Total New Balance plus any portion of the Minimum Payment(s) shown on prior statements which remain unpaid, or $25.00, whichever is greater, unless: (a) your Total New Balance is $25.00 or less, in which event the entire amount shall be due, or (b) your Outstanding Balance exceeds your Maximum Credit Limit, in which event the Minimum Payment will be the amount of the excess plus 3.00% of the Total New Balance plus the unpaid portion of any Minimum Payment shown on prior statements. If we allow you to skip a monthly payment, finance charges will continue to be applied to your outstanding balance. Also, this will not extend the time within which you must pay your Total New Balance in order to avoid a finance charge on purchases. The Minimum Payment will be due in the month following the month you skip.
7. FINANCE CHARGES–Finance Charges on cash advances (commonly known as “Method A”) begins from the date you obtained the cash advance, or the first day of the billing cycle in which it is posted to your account, whichever is later. There is no grace period. Finance Charges on Purchases (commonly known as “Method E”) is based on average daily balance excluding current transactions. To avoid incurring an additional Finance Charge on the balance of purchases reflected on your monthly statement, you must pay the New Balance shown on your monthly statement on or before the payment due date. The grace period for the New Balance of purchases extends to the payment due date. The Finance Charges for a billing cycle are computed by applying the monthly periodic rate to the average daily balance of your account. To get the average daily balance, we take the beginning balance of your account each day, add any new purchases or cash advances, and subtract any payments, credits, non-accruing fees, and unpaid finance charges. This gives us the daily balance. Then we add up all the daily balances for the billing cycle and divide the total by the number of days in the billing cycle. To avoid incurring an additional Finance Charge on the balance of purchases reflected on your monthly statement, you must pay the New Balance shown on your monthly statement on or before the payment due date. The grace period for the New Balance of purchases extends to the payment due date.
8. ANNUAL PERCENTAGE RATES (APR) – and corresponding Monthly Periodic Rates used to calculate interest are:
A. Platinum VISA®
Purchases, Balance Transfers and Cash Advances: ANNUAL PERCENTAGE RATE 9.00%; Monthly Periodic Rate .7500%.
B. Gold VISA®
Purchases, Balance Transfers and Cash Advances: ANNUAL PERCENTAGE RATE 12.00%; Monthly Periodic Rate 1.000%.
C. Classic VISA®
Purchases, Balance Transfers and Cash Advances : 16.50% APR; Monthly Periodic Rate 1.375%.
D. New Start Visa®
Purchases, Balance Transfers and Cash Advances: 17.99% APR; Monthly Periodic Rate 1.499%.

9. APPLICATION OF PAYMENTS: We will apply your payments in the following order:

  • Finance Charges
  • Previously billed Purchases
  • Other Fees and Charges
  • Cycle-to-date Cash Advances
  • Previously billed Cash Advances
  • Cycle-to-date Purchases

However, we reserve the right to apply payments in any manner we choose.
10. LATE CHARGES–If the minimum required payment is not received within 5 days after the Closing Date subsequent to the payment Due Date, a late charge up to $25.00, or 0% of the unpaid portion of the past due amount is imposed, but not to exceed $25.00.
11. OTHER FEES AND CHARGES– Your Card Account will be subject to the following fees and charges:
A. Return Check Charges: You will be assessed a charge up to $25.00 in the event any personal check tendered by you for any payment is returned for insufficient funds or dishonored for any reason whatsoever. You will be assessed a charge up to $25.00 in the event of any dishonor of a third party check tendered in payment of your obligations under the Plan.
B. Cash Advance Fee: $0.00
C. Balance Transfer Fee: $0.00
D. Annual Fee: : Platinum VISA®– None, Gold VISA®– None, Classic VISA®– $25.00, New Start VISA®– $50.00
12. SECURITY – No security interest is retained in any property purchased under the Plan. With respect to this account, by the acceptance and use of the Credit Card provided you hereby grant to us to secure payment of your VISA® Account a security interest in ALL OF YOUR SHARE ACCOUNTS AND CASH DEPOSITS, NOW OR IN THE FUTURE ON DEPOSIT WITH US, with the exception of any account that if pledged would have adverse tax consequences. If you are in default, you authorize EXCEL FCU to apply the funds in such accounts to the payment of your Credit Card account(s). You further understand that the granting of a security interest is a condition of the approval of a Credit Card account. If your VISA® card is a share secured VISA® account, you understand that your pledge amount equals your credit limit and such amounts are specifically pledged as security for this type account. The Credit Union may, but does not have to allow you to withdraw a portion of pledged amounts without affecting its security interest.
Cross Collateral. If you have other loans with us, or take out other loans with us in the future, collateral securing those loans will also secure your obligations under this Agreement. However, unless you expressly agree otherwise, your primary dwelling will not secure your obligation under this Agreement even if we have or later acquire a mortgage on the dwelling.
13. LIABILITY FOR UNAUTHORIZED USE – EXCEL FCU protects its members from fraudulent use of their VISA® cards with a zero liability policy. You are not held responsible for fraudulent charges to your account. However, to avoid the tedious task of resolving charges, notify us immediately if your card is lost or stolen. You may notify us orally or in writing at: Excel Federal Credit Union at 5070 Peachtree Industrial Blvd., Peachtree Corners, GA 30071 or telephone us at (888) 441-9235 or Credit Card Security Department, P.O. Box 30035, Tampa, FL 33630, Telephone: (727) 570-4881. You will not be liable for unauthorized use that occurs after you notify us at the phone number or address for the credit union on the reverse, orally or in writing, of the loss, theft, or possible unauthorized use. In any case, your liability will not exceed $50.00.
14. EVENTS OF DEFAULT – You will be in default under this Agreement if any of the following events should occur: (a) If you fail to make any Minimum Payment on or before the due date on each Periodic Statement; (b) If you fail to comply with any other terms or conditions of this Agreement or any other Agreement you have with the Credit Union; (c) If you should die or become insolvent; (d) If a petition should be filed or other proceeding should be started under the Federal Bankruptcy Code or any State insolvency statute by or against you; (e) If a Receiver should be appointed or a writ or order of attachment, levy or garnishment should be issued against you or any of your property, assets or income.
15. ENTIRE BALANCE DUE – If any of the above events of default should occur, the Outstanding Balance shall immediately become due and payable at our option, without notifying you, with interest due on this balance until paid, and the Credit Union’s obligation to honor your use of the Card to get credit extensions from anyone or to make further Cash Advances shall at our option, and without notice, immediately end. If you fail to pay the entire Outstanding Balance immediately, upon demand, you agree to pay in addition all of the Credit Union’s collection expenses, including reasonable attorney’s fees, not less than 15% of the entire Outstanding Balance.
16. TERMINATION – Either we or you may terminate this Agreement as to further Cash Advances or Purchases by giving written notice, but any termination shall not relieve you of any of your obligations existing under this Agreement prior to its termination, including your obligations to pay the Outstanding Balance on your account. The Cards remain our property and you must recover and surrender to us all Cards upon our request and upon termination of this Agreement. You agree not to use any expired or cancelled Card to obtain or try to obtain credit from anyone honoring the Card.
17. EFFECT OF AGREEMENT – This Agreement is the contract which applies to all transactions on your account even though the Purchases, Cash Advances, credit or other slips you sign or receive may contain different terms. We may amend this Agreement from time to time by sending you the advance written notice required by law. Your use of the Card thereafter will indicate your agreement to the amendments, including any increase or decrease in the Finance Charge or other charges provided in this Agreement. To the extent the law permits and we indicate in our notice, amendments will apply to your existing account balance as well as to future transactions.
18. RETURNS AND ADJUSTMENTS – Merchants and others who honor the Card may give credit returns or adjustments, and they will do so by sending us a credit slip which we will post to your account. If your credits and payments exceed what you owe us, we will hold and apply this credit balance against future Purchases and Cash Advances or if it is $1.00 or more, refund it upon your written request or automatically within six (6) months.
19. NOTICES – You agree and attest that your name and address shown in the Application is your legal name and the place of your residence, and such address is the proper address for all notice(s), and you further understand that any changes in this address must be submitted to us in writing to be effective. Notices you give to us shall be considered to have been given when placed in the United States Mail, postage prepaid, and addressed to Excel Federal Credit Union, 5070 Peachtree Industrial Blvd., Peachtree Corners, GA 30071.
20. FOREIGN TRANSACTIONS – Purchases and Cash Advances made in foreign countries and foreign currencies will be billed to you in U.S. Dollars. The conversion rate to dollars will be made in accordance with the operating regulations for international transactions established by VISA® International, Inc. The conversion rate to dollars will be at (a) a rate selected by VISA® from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate VISA® itself receives, or (b) the government-mandated rate in effect for the applicable central processing date. In each of the preceding instances, plus or minus any adjustment determined by the Issuer. A fee of 1 percent will be imposed on all foreign transactions, including purchases, cash withdrawals, cash advances and credits to your account. A foreign transaction is any transaction that you complete or a merchant completes on your card outside of the U.S.
21. PLAN MERCHANT DISPUTES – We are not responsible for the refusal of any plan merchant or financial institution to honor your card. We are subject to claims and defenses (other than tort claims) arising out of goods or services you purchase with the card only if you have made a good faith attempt, but have been unable to obtain satisfaction from the plan merchant, and: (a) your purchase was made in response to an advertisement we sent or participated in sending you; or (b) your purchase cost more than $50 and was made from a plan merchant in your state or within 100 miles of your home. Any other disputes you must resolve directly with the plan merchant.
22. LAW GOVERNING – This Agreement shall be governed by the laws of the State of Georgia and applicable Federal law.
You authorize the use of electronic signatures, facsimile signatures and photocopied signatures for all purposes, said signatures to have the same force and effect as original signatures for all transactions, included in applications or agreements with us.
23. USING YOUR CARD – You may use your EXCEL FCU VISA® Card to conduct any transaction or obtain any credit union service permitted by law except gambling or online internet gambling. You agree that the use of the VISA® Card to obtain a service or effect a transaction that is illegal under the law of any jurisdiction where originated, effected or accomplished will be a default and breach of this Agreement. EXCEL FCU may terminate the access to the service or withdraw the right to use the VISA® Card and/or demand the return of all VISA® Cards or other access devices issued to you. If illegal use of your VISA® Card occurs, you waive the right to sue EXCEL FCU, and agree to indemnify and hold EXCEL FCU harmless from any suits or other legal action or liability which may be asserted, directly or indirectly, against EXCEL FCU arising out of or resulting from the illegal use of the VISA® Card.

BILLING RIGHTS

This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act.
NOTIFY US IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR STATEMENT
If you think your statement is wrong, or if you need more information about a transaction on your statement, write to us on a separate sheet at Excel Federal Credit Union, 5070 Peachtree Industrial Blvd., Peachtree Corners, GA 30071.
We must hear from you no later than 60 days after we sent you the first statement on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights.
In your letter, give us the following information:

  • Your name and account number.
  • The dollar amount of the suspected error.
  • Describe the error and explain, if you can, why you believe there is an error.

If you need more information, describe the item you are not sure about. Questionable Transactions or errors not resolved to your satisfaction, by the Credit Union staff, should be brought to the attention of the Supervisory Committee’s Audit Department by writing to the Supervisory Committee at 5070 Peachtree Industrial Blvd., Peachtree Corners, GA 30071.

YOUR RIGHTS AND OUR RESPONSIBILITIES AFTER WE RECEIVE YOUR WRITTEN NOTICE

We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the statement was correct.
After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to send statements to you for the amount you question, including finance charges, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your statement that are not in question.
If we find that we made a mistake on your statement, you will not have to pay any finance charges related to any questioned amount. If we didn’t make a mistake, you may have to pay finance charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due.
If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within ten days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your statement. We must tell you the names of anyone we report you to and when the matter is settled, we must also notify those parties.
If we don’t follow these rules, we can’t collect the first $50 of the questioned amount, even if your statement was correct.
SPECIAL RULE FOR CREDIT CARD PURCHASES
If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. There are two limitations on this right: (a) You must have made the purchase in your home state, or, if not within your home state, within 100 miles of your current mailing address; and (b) The purchase price must have been more than $50. These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.

SCORECARD® REWARD POINTS

Unredeemed ScoreCard® Reward Points will not be cleared or zeroed out until further notice, and not without thirty days’ notice. In the event of default or closed card account, all points will be forfeited.

VISA has increased their International Service Assessment fee (ISA) from .80% to 1.00% of each single currency transaction in U.S. dollars. These changes will take effect on 4.13.2019. You can avoid the ISA fee by not using your credit card when traveling outside the U.S.
